1. Parties

This Terms of Service Agreement ("Agreement") is entered into between the real or legal person ("User") using the RawdahBooking platform and the Company.

Anyone who uses the platform is deemed to have accepted the provisions of this Agreement.

2. Subject Matter of the Agreement

This Agreement governs the terms of use of the RawdahBooking platform, the scope of services provided, the pricing model, and the rights and obligations of the parties.

RawdahBooking provides services as;

  • Tourism operational management software (SaaS), 
  • Reservation and transaction infrastructure, 
  • Data processing and operational support system. 

3. Nature and Limitations of the Service

The User acknowledges that:

  • The platform is not a service that guarantees results. 
  • No specific outcome (e.g., visa approval, confirmed appointment date, third-party approval) is guaranteed in any way. 
  • The service is solely the management of operational processes and the provision of digital infrastructure. 

The Company has no control over third-party systems (consulates, external APIs, public institutions, etc.).

4. Integrations and Technical Dependencies

The platform;

  • May operate integrated with third-party systems. 
  • Changes, disruptions, or updates in these systems may affect the service flow. 
  • Delays arising from integration changes shall not be deemed a fault of the Company. 

The Company may make system updates to improve and adapt the service.

5. Pricing and Service Model

  • The platform is a paid SaaS service. 
  • Users pay via credits/balance or transaction-based pricing through the system. 
  • The service is usage and transaction-based, not time-based. 
  • Service is rendered through the balances used. 

All payments are invoiced by Rawdahbooking.

6. CANCELLATION AND REFUND POLICY

The User acknowledges that:

  • The service qualifies as a digital service performed immediately upon payment and data upload. 
  • Once the operation is initiated, the service is considered to have commenced. 

Therefore:

  • No refunds are provided for services that have been initiated or performed. 
  • Unused balances are non-refundable except in cases of contractual breach. 

Exceptional cases are evaluated only if the Company is technically unable to initiate the service.

7. CHARGEBACK POLICY

The User acknowledges that they will not make unjustified chargeback requests through banks or payment providers.

The Company:

  • Records all transactions (logs, transaction history, invoices, system records). 
  • Has the right to present these records as evidence in cases of unjustified chargebacks. 

Unjustified chargeback attempts may result in:

  • Account restriction 
  • Service termination 
  • Initiation of legal proceedings 

8. DISPUTES AND EVIDENCE

In the event of disputes between the parties;

  • System logs 
  • User transactions 
  • Payment records 
  • Invoices 
  • Technical records 

shall constitute definitive and binding evidence.

9. LIMITATION OF LIABILITY

The Company shall not be held liable for:

  • Indirect or consequential damages 
  • Delays caused by third-party systems 
  • User errors 
  • Data entry errors 

The Company's total liability may be limited to the amount paid for the relevant service.

10. USER OBLIGATIONS

The User is solely responsible for:

  • The accuracy of data entered into the system 
  • Lawful acquisition of data 
  • Obtaining all necessary permissions 

11. ACCOUNT SUSPENSION AND TERMINATION

The Company may suspend or terminate the service in the following cases:

  • Unfair or abusive use 
  • Chargeback abuse 
  • Unlawful use of data 
  • Actions threatening system security 

12. DATA USAGE AND RECORDING SYSTEM

The User acknowledges that all transactions carried out on the system are recorded and that these records may be used for service quality, security, and legal proceedings.

13. FINAL PROVISION

By using the platform, the User is deemed to have accepted all provisions of this Agreement.
